Ashley St. Clair Sues Elon Musk for Custody of Alleged 13th Child, Claims He Said: ‘I Want to Knock You Up Again’

Elon Musk is facing a new legal battle as conservative commentator Ashley St. Clair has filed a paternity lawsuit against the billionaire, 

seeking sole custody of their alleged newborn son. According to court documents obtained by Page Six, 

St. Clair alleges that Musk is the father of her child and has requested genetic testing to confirm paternity.

Paternity Suit and Custody Battle

St. Clair, 26, filed the suit in New York on Friday, claiming that she and Musk, 53, began their relationship in May 2023. 

She asserts that their intimate encounters on January 2 and January 3, 2024, led to the conception of their son, whose name and birth date remain redacted in legal documents. However, his first initial is listed as “R.”

In her filing, St. Clair stated that she had no other partners during the time of conception, reinforcing her belief that Musk is the child’s father. She has urged the court to compel Musk to undergo DNA testing to establish paternity definitively.

Text Messages as Alleged Evidence

St. Clair’s court documents include a series of text messages allegedly exchanged with Musk, which she claims demonstrate his acknowledgment of their child. One of the messages she provided shows Musk responding to a hospital photo of St. Clair and the newborn, saying, “I look forward to seeing you and him this weekend.”

Another message, dated November 24, 2024, allegedly has Musk stating, “I want to knock you up again.” According to St. Clair, he reiterated a similar sentiment as recently as February 2, commenting, “Well, we do have a legion of kids to make.”

Their past online interactions have also resurfaced, including flirtatious messages that reportedly reference intimate moments and sexual positions.

Seeking Sole Custody

Although St. Clair is not currently seeking financial child support from Musk, she has requested that the court establish a temporary support order for their child. Additionally, she is seeking sole legal custody, arguing that she has been the sole caregiver for their son since birth.

“I am the only parent to make decisions for R.S.C. I schedule and take him to all his medical appointments,” she stated in the court filings. “I am the only parent who cares for him on a daily basis. I feed him, bathe him, and ensure that all his physical and emotional needs are met.”

According to St. Clair, Musk was not present for the birth of their child, despite having the opportunity to attend. She further alleges that he has shown little interest in playing an active role in their son’s life.

Limited Contact with Child

The court documents also detail Musk’s alleged limited involvement with the child. St. Clair claims that he has only met their son on three occasions: a two-hour visit in New York on September 21, 2024, followed by a one-hour meeting the next day, and a final 30-minute encounter in Austin, Texas, on November 30, 2024.

“Respondent has never asked to see our child on any other occasion, he has never communicated to me about our child without my prompting, he has never asked for photos of our child or checked in after doctor’s appointments,” she stated in the filings.

Going Public with the Allegations

St. Clair first revealed her alleged connection to Musk on February 14 via a post on X (formerly Twitter), writing, “Five months ago, I welcomed a new baby into the world. Elon Musk is the father.” She added that she had initially kept the information private to protect their child’s safety but was forced to go public due to impending media reports.

In her legal filings, she also claimed that she attempted to resolve the matter privately to avoid public scrutiny.

Elon Musk’s Response and Family Tensions

Musk has not publicly responded to the lawsuit or issued a statement regarding the allegations. However, his 21-year-old estranged daughter, Vivian Wilson, appeared to react to the situation with a TikTok post that read, “Wow, if I had a nickel for every time I found out I had half-siblings through Reddit, I’d have two nickels… which isn’t a lot but it’s weird that it’s happened twice, right?”

This legal battle comes amid another custody dispute between Musk and his ex, musician Grimes, over their three children: X Æ A-Xii, 4, Exa Dark Sideræl, 3, and Techno Mechanicus, 2.

On February 22, Grimes took to social media, accusing Musk of neglecting their child’s medical emergency. “I’m not giving any details, but he won’t respond to texts, calls, or emails and has skipped every meeting,” she wrote. “Our child will suffer lifelong impairment if he doesn’t respond ASAP, so I need him to f–king respond.”

What’s Next?

With the lawsuit now public, all eyes are on Musk to see how he will respond to the paternity and custody claims. Whether he chooses to acknowledge or contest the allegations remains to be seen, but the legal battle is likely to draw significant attention given his high-profile status and existing family controversies.
